HRF Files Criminal Complaint Against Israeli Politicians Ram Ben Barak and Moshe Solomon for Incitement to Genocide Ahead of OSCE Session in The Hague

3 July 2026, Brussels, Belgium / The Hague, The Netherlands – The Hind Rajab Foundation (HRF) has filed a criminal complaint in the Netherlands against two members of the Knesset, Ram Ben Barak and Moshe Solomon, for incitement to genocide. The complaint coincides with their scheduled attendance at the 33rd Annual Session of the OSCE Parliamentary Assembly in The Hague, Netherlands, from 4–8 July 2026.

HRF’s investigation alleges that both politicians have used their positions of authority to publicly advocate for policies aimed at the physical destruction and permanent displacement of the Palestinian population in Gaza. With over 73,000 Palestinians killed and nearly 80% of Gaza’s infrastructure destroyed since October 2023, HRF argues that their rhetoric may constitute direct and public incitement to genocide under international law.

Ram Ben Barak: Advocating for the Dissolution of the Palestinian Group

Ram Ben Barak, a member of the Knesset Foreign Affairs and Defense Committee and head of Israel’s delegation to the OSCE PA, has been promoting the “voluntary migration” of Palestinians from Gaza. In November 2023, Ben Barak proposed relocating Gaza’s population to more than 100 countries, stating, “If each country takes in 20,000 individuals… it is better to be a refugee in Canada than in Gaza.”

Despite later claims that he was misunderstood, he continued to frame mass displacement as a solution, effectively advocating for the prevention of the Palestinian group’s reconstitution in Gaza.

HRF asserts that advocating for such a proposal aligns with the legal definition of forcible transfer as an act of genocide when intended to destroy a group in whole or in part.

Ben Barak knows that Gaza’s population has no genuine choice to remain: water and electricity have been cut off, famine has been induced by the Israeli blockade, the population was and continues to experience constant attacks, and thousands of civilians have already been killed.

By suggesting "voluntary" relocation in such a context and advocating for the dispersal of Palestinians to more than 100 countries, Ben Barak has been explicitly promoting the dissolution of the Palestinian national group in Gaza, preventing its reconstitution and continuity. 

Moshe Solomon: Advocating for the Occupation of Gaza and Demographic Erasure

Moshe Solomon, a figure in the Religious Zionist Party, is implicated for championing the re-establishment of illegal settlements in Gaza. By insisting that Israel's security requires permanent Jewish control of the land in Gaza and rejecting any Palestinian autonomy, Solomon is advocating for a demographic transformation that can only be achieved through the continued killing and displacement of Palestinians. Solomon has persisted in this stance during ceasefires and after international bodies, including the International Court of Justice (ICJ) and International Criminal Court (ICC), have recognized the genocidal nature of Israel’s campaign.

A Growing Consensus on Israel’s Genocide

HRF's complaint has been filed amidst a growing consensus in the international legal community that Israel's war in Gaza meets the legal threshold for genocide. This assessment includes findings by the ICJ, which recognized a plausible genocide and ordered provisional measures to prevent genocidal acts, and reports by UN bodies and experts, as well as human rights organizations, including Amnesty International, all of whom have documented acts consistent with genocidal intent.

Calls for Accountability

HRF calls on the Dutch authorities to take immediate action to hold these two individuals accountable and to investigate their criminal responsibility for incitement to genocide.

They are public incitements to commit genocide, delivered by officials with direct influence over state policy and military oversight. Their presence at the OSCE session, themed ‘International Law and Shared Principles,’ stands in stark contradiction to the atrocities they have helped legitimize.

Under established international jurisprudence, including precedents set by the International Criminal Tribunal for Rwanda and International Court of Justice, public figures with significant influence who make direct calls for the dispersal or elimination of a protected group bear individual criminal responsibility for incitement to commit genocide. Ben Barak’s explicit proposal to relocate Palestinians from Gaza across the globe, coupled with Solomon’s insistence on permanent settlement on Palestinian lands in Gaza that necessitates demographic erasure, satisfies the specific intent required for the crime of incitement to genocide.

The Hind Rajab Foundation continues to pursue legal avenues across Europe to hold those responsible for the atrocities in Gaza accountable. This case represents a critical test of whether European states will fulfill their international legal obligations or protect alleged perpetrators.
